By purchasing a Next Play Athlete+ package and submitting this onboarding form, you ("Athlete" or "Client") and, if applicable, your parent or legal guardian agree to be bound by these Terms & Conditions ("Terms") with Next Play ("Company," "we," "us," or "our"). These Terms govern your access to and use of all Next Play Athlete+ services, including profile creation, graphic design, film organization, recruiting support, and any related deliverables.

If the Athlete is under the age of 18, a parent or legal guardian must review and agree to these Terms on the Athlete's behalf.

Next Play Athlete+ provides the following services based on the package selected at time of purchase:

• Public athlete profile page hosted on joinnextplay.com
• Full recruiting profile including stats, measurables, bio, and academic info
• Media and graphics gallery
• Film integration via Hudl or other linked platforms
• Social media section
• Awards and achievements section
• Custom athlete branding using your school colors
• Shareable profile URL
• Contact section
• Includes your first 30 days of hosting and access at no additional charge

• New custom graphics delivered monthly
• Stat and schedule updates
• Written feature stories
• Monthly analytics report
• Recruiting tips newsletter
• Access to your private Athlete+ dashboard
• Cancel anytime — no contracts

Next Play reserves the right to modify service offerings at any time. Existing clients will be notified of any material changes.

3.1 One-Time Build. Payment for the Athlete+ Build is due in full at the time of purchase. Work will not begin until payment is confirmed. Your first 30 days of hosting are included in this payment.

3.2 Monthly Membership. If added, the Athlete+ Membership begins automatically after your first 30 days and is billed monthly at $19/month on the date your trial period ends. Membership will auto-renew each month until cancelled.

3.3 Cancellation. Monthly membership may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No partial month refunds will be issued.

3.4 Refunds. The one-time build fee is non-refundable once profile build work has begun. If work has not yet started, a full refund may be requested within 48 hours of purchase. Membership fees already charged are non-refundable.

3.5 Failed Payments. If a monthly membership payment fails, access to membership benefits will be suspended until payment is resolved. Next Play will attempt to notify the client via email on file.

4.1 Client-Provided Assets. You retain ownership of all photos, videos, statistics, and personal information you provide to Next Play. By submitting these assets, you grant Next Play a non-exclusive license to use them solely for the purpose of building and maintaining your Athlete+ profile.

4.2 Next Play-Created Content. All graphics, written content, profile copy, design work, and other materials created by Next Play remain the intellectual property of Next Play until full payment is received. Upon full payment, the Athlete receives a license to use all delivered materials for personal recruiting and promotional purposes.

4.3 Portfolio Use. Next Play reserves the right to display your profile, graphics, and related work in its portfolio, marketing materials, website, and social media for the purpose of promoting Next Play services, unless you opt out in writing.

4.4 Opt-Out. To opt out of portfolio use, notify Next Play in writing at the time of onboarding or at any time thereafter by emailing hello@joinnextplay.com.

5.1 Accuracy of Information. You are responsible for ensuring that all information submitted — including stats, academic data, contact information, and recruiting details — is accurate and up to date. Next Play is not responsible for errors resulting from inaccurate information provided by the client.

5.2 Asset Delivery. You agree to provide all requested photos, logos, film links, and other assets in a timely manner. Delays in asset delivery may result in delays in profile completion. Next Play is not responsible for timeline delays caused by late asset submission.

5.3 Stat Verification. Next Play may use publicly available sources such as MaxPreps to verify statistics. You are responsible for ensuring your stats are accurately logged on any third-party platforms referenced in your profile.

5.4 Profile Review. You will have the opportunity to review your completed profile before it is published. Once approved and published, any subsequent changes may be subject to additional fees depending on scope.

5.5 Communication. You agree to respond to Next Play communications within a reasonable timeframe. Failure to respond for 30 or more days may result in your project being placed on hold.

6.1 Hosting. Athlete profiles are hosted on joinnextplay.com via Webflow. Next Play maintains control of the hosting environment. Profile hosting is included for the duration of your active relationship with Next Play.

6.2 Profile Availability. Next Play will make reasonable efforts to maintain profile uptime and availability. We are not responsible for downtime caused by third-party hosting providers, internet service disruptions, or circumstances outside our control.

6.3 Profile Removal. Next Play reserves the right to remove or suspend a profile that contains inaccurate information, violates these Terms, or is associated with an account in default on payment.

6.4 Inactive Profiles. Profiles associated with lapsed memberships or accounts with outstanding balances may be deactivated after 60 days of inactivity or non-payment. You will be notified before deactivation.

7.1 Athlete Responsibility. It is your sole responsibility to ensure that your use of Next Play Athlete+ services complies with all applicable NCAA, NAIA, NJCAA, state athletic association (e.g., KSHSAA), and school district rules and regulations regarding recruiting, amateurism, and promotional materials.

7.2 No Guarantee of Recruitment. Next Play does not guarantee any recruiting outcomes, scholarship offers, college placements, or athletic opportunities. Our services are designed to increase visibility and improve presentation — outcomes depend on athletic ability, academic performance, and coach decisions entirely outside our control.

7.3 Compliance Disclaimer. Next Play is not a licensed recruiting service or NCAA-certified agent. We are a communications and media service. Clients should consult their high school athletic director or compliance staff with any questions about recruiting rules.

8.1 Data Collection. By submitting this form, you authorize Next Play to collect and store the personal information provided, including name, contact details, academic information, athletic statistics, and photos, for the purpose of building and maintaining your profile.

8.2 Data Sharing. Next Play will not sell or share your personal information with third parties for marketing purposes. Information may be shared with service providers (e.g., Webflow, ClickUp) solely as necessary to deliver our services.

8.3 Minor Privacy. For athletes under the age of 18, parental or guardian consent is required. By signing below, the parent or guardian confirms they have reviewed and approved the submission of the Athlete's personal information.

8.4 Data Removal. You may request removal of your personal data and profile at any time by emailing hello@joinnextplay.com. Requests will be processed within 14 business days.

To the fullest extent permitted by law, Next Play shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Athlete+ services, including but not limited to loss of recruiting opportunities, reputational harm, or data loss. Next Play's total liability to any client shall not exceed the total amount paid by that client in the 12 months preceding the claim.

Any disputes arising from these Terms or Next Play Athlete+ services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in the State of Kansas in accordance with the rules of the American Arbitration Association. Both parties waive the right to a jury trial.

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict of law principles.

Next Play reserves the right to update these Terms at any time. Clients will be notified of material changes via email. Continued use of Athlete+ services after notification constitutes acceptance of the updated Terms.

These Terms, together with your selected package confirmation and any written agreements between you and Next Play, constitute the entire agreement between the parties and supersede all prior discussions, representations, or agreements.
